Welcome to oshostar.com. This website is owned and operated by Maria Kastrioti, sole proprietorship incorporated under the greek law with its registered office located at: Demokratias Avenue 61, Dionyssos, Attiki, P.O 14576, GR

This agreement is in effect as of May 26, 2021 and it is available only in English language.

The following terminology applies to these Terms and Conditions and any or all Agreements: “User”, “You”, and “Your” refers to you, the person accessing this Website and accepting the Company’s terms and conditions. “OSHOstar”,“Ajita Maria Kastrioti”, “the Company”, “I”, “me”, “my”, “mine”, refers to the sole proprietorship. “Party”, “Parties”, “Us” refers to both the User and the Company or either the User and the Company.

2. USER CONSENT & OBLIGATION

Please read carefully these Terms and Conditions (hereinafter ‘User Agreement’) before using the Website or accessing any material, information, resources or services through the Website. The access and use of the Website and/or of any Services through the Website shall signify your acceptance of this User Agreement along with the Privacy Policy and your agreement to be legaly bound by the same.

Ι reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that is your responsibility to review this User Agreement periodically to familiarize yourself with modifications. Your continued use of site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

You are under obligation not to violate the Privacy Policy, these Terms and Conditions and any other terms as defined on the Website. You represent that you are an individual and not a corporation or other legal business entity. The rights to use the Website’s services is personal to the User.

3.PAID SERVICES - ELIGIBILITY

The Website is an internet-based portal having its existence on World Wide Web and provides meditation and astrological services, content and consultations via zoom online platform, telephone or e-mail. (hereinafter referred as “Content”). The Website is offering “Paid Services” (collectively referred as “Services”) such as meditation groups, individual meditation sessions, astrology sessions, Reiki sessions, OSHO Zen Tarot sessions and other alternative therapies and/or spiritual services. All of the Services are provided online via ZOOM, other electronic media such as telephone, e-mail, or in person. Ajita Maria Kastrioti has the exclusive right to decide, manage and choose when, how and which way the Service will be delivered to You.

3.1. In order to get access to Paid Services and/or receive additional Content, you are required:

- to be over 18 years old.

- to book online the Service you are interested in and provide us with current, complete, and accurate information about yourself.

- to have read these Terms and Conditions and accepted them by clicking on the tick box provided for this purpose. If you do not agree with the Terms and Conditions, please do not click on the relevant tick box button and do not make use of the Website or the Services.

- not to impersonate any other person or entity to use false name or name not authorized to use.

- to be physically and mentally healthy. The Content and Services offered by the Company are not meant to replace any medical treatment. Any information received from the Website or from the use of a Service should not be considered as medical advice. You should always seek for an appropriate qualified health care professional for diagnosis and treatment including information regarding which medications or treatment may be appropriate for you.

- not to be under medication treatment or other substances that affect your consciousness and mental functions such as alcohol, psychiatric medicines, drugs etc.

3.2 Furthermore, by booking and registering to online Paid Services offered by Ajita Maria Kastrioti You hereby agree that:

All Services are payable in advance of attending a session / group.
You are responsible for the payment of the Service fee as well as any associated taxes and any bank or online payment platform commissions.
Your personal data including without limitation to details relating to debit/ credit card transmitted over the Internet may be susceptible to misuse, hacking, theft and/or fraud and that the Company has no control over such matters.
You are fully and lawfully entitled to use such credit/debit cards. The debit/credit card details provided by you for booking any of the Services must be correct and accurate and you shall not use a debit / credit card that is not lawfully owned by you or the use of it is not authorized by the lawful owner thereof.

3.2.b. Health condition and responsibility

You access the Services with your own responsibility and your physical and mental condition permits you to do so.
You are the solely responsible for the decision to practice meditation, breathing and relaxation techniques and you have no known medical condition which could prevent you from taking part in such sessions. You assume all responsibility for any risk or injury that you may sustain as a result from your participation.
You do not suffer from any physical or mental illness that can be affected by your accessing the Services and your participation in any of the groups or sessions offered by Ajita Maria Kastrioti.
You do not suffer from any physical or mental illness that can affect the smooth conduct of any of the Services including the groups and sessions provided by Ajita Maria Kastrioti.
You do not follow any medical treatment that affect your mental functions and You are not under the effect any other substances that affect your consciousness and mind such as psychiatric medicines, alcohol, drugs etc.
It is your responsibility to advice the session giver / meditation facilitator of any physical or mental condition that may limit your participation or access to any Service and to work only within your limitations.

3.2.c.Copyrights

You are not in any way permitted to record (audio and video), copy, duplicate, reproduce, share, sell, trade or resell any of the Content of the Website or content of the Services provided by Ajita Maria Kastrioti.
You are solely responsible for any consequences, losses, or damages that I may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.

3.2.d. Permission to contact You

You are giving your unconditional consent to Ajita Maria Kastrioti to contact you in your mobile number or e-mail address that you have submit in the Website for any purpose related to the Services such as arrangement of a session, amendments, further information etc

3.2.e. Booking / Registration – Attending

- For any meditation group / event you need to book and register to it before the start of the group / event.

- For any individual session of meditation, astrology and Reiki you need to book and register at least one day (24hours) prior to the start of a session. In any case, the appointment date of the Service delivery will be finally arranged by Ajita Maria Kastrioti in co-ordination with you, according to service availability and preparation needs.

- You are on time for the session booked. Recommended logging time for all the online sessions is 5-10 minutes before start.

- You lose the right to attend a group / event / session when booked and over 5 minutes late. In this case no refund will be given.

4. PRIVACY

You hereby consent, express and agree that You have read and fully understand the Privacy Policy of the Website. You further consent that the terms and contents of such Privacy Policy is acceptable to You inclusive of any update/ alteration/ change made and duly displayed on the Website.

5. CONFIDENTIALITY

All information shared by You while undertaking any of the Services is held to the strictest standards of confidentiality. Except as provided herein or in the Privacy Policy, no disclosures of any information shall be made by Me with regard to any information shared by You while availing of the Services. The requirement for confidentiality shall not apply in cases where a direction to disclose information is received from the police, the court or competent jurisdiction.

6. LIMITATION OF WARRANTIES

By using this Website you understand and agree that all Content and Services I provide is “as is” and “as available”. This means that the Company do not represent or warrant to you that :

The Services will meet your needs or requirements.
The Services will be uninterrupted, timely, secure or free from errors.
The information obtained from the use of Services will be accurate or reliable.
The quality of any services, information or other material obtained by you through the Service will meet your expectations.

You also understand and agree that:

No information or advice, whether expressed, implied, oral or written, obtained by you from the Website or through the use of the Services shall create any warranty, guarantee, or conditions of any kind, except for those outlined in this User Agreement.
You shall not have a cause of action or legal remedy or be entitled to a refund should You not achieve the results desired following any of the Services.
You are voluntarily choosing to avail of the Services provided by me and that you are solely responsible for any outcome or results.

7. LIMITATION OF LIABILITY

In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against Ajita Maria Kastrioti shall be limited to the amount You paid, if any, for the use of the Service. The Company will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of any changes, data, loss, corruption, cancellation, loss of access or downtime to the full extent that applicable limitation of liability laws apply.

8. COPYRIGHTS / TRADEMARKS

The Website and any individual Websites which may be available through external hyperlinks with the Website are private property.

All content and materials available on OSHOstar.com, including but not limited to text, graphics, website name, images and logos are the intellectual property of OSHOstar and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Ajita Maria Kastrioti.

9. BREACH AND TERMINATION

The Company may, in whole or in part, without informing You, to modify, discontinue, change or alter the services ordered. The Company may or may not issue notice or provide any reason for such action taken by the Company.
Violation of any conditions mentioned in this User Agreement shall lead to immediate cancellation of the Service booked by You. I reserve the right to terminate and initiate action immediately, if :

I am not able to verify and authenticate your personal data or any other relevant information provided by You.
I believe that your actions may disturb or do disturb in any way the smooth conduct of the group/event or disturb the facilitator/ session giver and other Users/ Participants of the Group/Event.
I believe that your actions may cause legal liability to the Company, other Users/Participants or any service provider linked with the Website.
I believe that You have provided me with false and misleading Data or you have violated the Privacy Policy as listed by the Website.

I also reserve the right to withdraw my services to anyone who is found to be unreasonable or abusive during a group/event or during their conversation with Me in a private session or in any kind of communication such as call, e-mail etc.

In all of the above mentioned cases the termination of the Service for the User is immediate and no refund shall be given to the User.

10. DELIVERY, CANCELLATION AND REFUND

No refund shall be processed on the order of any reports under any circumstances if the order/booking has been complete and the User has received a confirmation e-mail for the booking of the Service by the Website or the Company. The risk and liability of placing order in a haste and careless manner totally lies with the User and the Company is not responsible for any refund once the processing stage has started.
No refund shall be processed once the Order/Booking has been placed and executed. However the User has the right to exchange the Service to another one of equal financial value and/or reschedule the booked Service to a later date or time, if there is such availability. The cancellation of a Service should not take place more than twice. The Service delivery should not exceed in any way more than 6 months from the original booking date. Any cancelation, change or rescheduling of Service requested by the User is always under the consent and approval of Ajita Maria Kastrioti. To be able to make use of the above right of rescheduling or exchanging the Service booked, you are required:

For any cancellation of your participation in groups – events Services: You should contact Ajita Maria Kastrioti by e-mail in the following address ajita.oshostar@gmail.com or by sms in the following number +306946064880 at least 1 hour prior to start the meditation group-event.
For any cancellation of individual session Service: You should contact Ajita Maria Kastrioti by e-mail in the following address ajita.oshostar@gmail.com or by sms in the following number +306946064880 at least 1 day (24 hours) prior to start the session as originally booked.

In failure to notify Ajita Maria Kastrioti within the time limits stated above about the cancelation, You will have no right to change, exchange, transfer or reschedule the Service you have booked and you will not use (or did not use).

Any technical delay or glitch reported in the Website during the processing of the request which includes generating reports by the service Provider, shall not be eligible for claiming refund. The User agrees that the timelines are approximate and all essentials steps would be taken to adhere to the timelines as displayed.
No refund shall be processed for the reason that incorrect information or data has been provided by You. The User agrees to be careful while providing any information to the Website and must re-check the information filled before submitting it in the Website. The User can request for change in the incorrect information or data entered provided by sending an e-mail to the following address ajita.oshostar@gmail.com before the delivery of any Service.
In case the Website or Payment gateway’s webpage, that is linked to the Website, is experiencing any server related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:

In case the Bank Account appears to be debited, ensure that you do not make the payment twice and immediately thereafter contact the Company to confirm payment.
In case the Bank Account is not debited, the User may initiate a fresh transaction to make payment.

However, refund for multiple payment, if any, even after the above precaution against the same order shall be refunded the full amount without the deduction of the transaction charges. The Company shall only retain the cost of one single order as intended to be placed by the User.

If there are orders that the Company is unable to accept and must cancel, the Company at its sole discretion, reserves the right to refuse or cancel any order for any reason whatsoever. Some situations may result in the order being cancelled and include, without limitation, non-availability of the service, inaccuracy, error in pricing information or other problems as identified. If the User’s order is cancelled after charges being paid against the said service, the said amount paid for booking shall be refunded.

11. GOVERNING LAW
By using this Website or any Service through it, You agree that any dispute related to these Terms or with the Company or the Services provided will be governed by the laws of Greece, without regard to principles of conflict of laws, and you agree to submit to jurisdiction of Greece.
